Lawrence G. Cetrulo and Michael J. Cahalane Published an Article on the United States' Supreme Court Decision in Air & Liquid Systems v. DeVries Regarding the "Bare-Metal" Defense
Partners Lawrence G. Cetrulo and Michael J. Cahalane recently published an article titled “The Supreme Court’s Decision in Air & Liquid Systems v. DeVries Signals the End for the Bare-Metal Defense”. This article was featured in the September/October, 2019 issue of The Federal Lawyer, a national magazine published by the Federal Bar Association.
The article argues that the Supreme Court’s decision in DeVries marks a dangerous expansion of liability for equipment manufacturers. While the Court’s decision that equipment manufacturers can be liable for asbestos-containing insulation applied by third parties is purportedly “cabined” in the maritime context, Cetrulo and Cahalane predict that DeVries will be used to erode the bare metal defense and expand liability in state court claims and other contexts.
