Cetrulo LLP, acting as Defendants’ Liaison Counsel in the Massachusetts Asbestos Litigation, filed a Brief as an Amicus Curiae in the matter of June Stearns and Clifford Oliver v. Metropolitan Life Insurance Company, et al. The brief urges the Supreme Court to repudiate attempts by Plaintiff’s counsel to read an exception into the Statute of Repose for latent diseases, such as those frequently associated with asbestos. In furtherance of this position, the brief referred the Court to the objectives of the legislature in originally enacting the Statute of Repose, the violations of due process that would result from weakening the Statute, and pointed to the significant public interest in leaving the Statute of Repose uncompromised.
