Toxic Tort Litigation

Overview

Cetrulo LLP is New England’s leading and fastest-growing law firm for toxic torts defense. For nearly 30 years, our firm has counseled clients in actions involving personal injury or property damage arising from exposure to a variety of potential toxins, including asbestos, benzene, beryllium, lead pigment, silicone gel, chemicals, gases, and particulates. Our experienced attorneys have earned a national reputation for their skill, intellect, foresight, attention to detail, and focus on client needs.

Our firm represents numerous toxic tort clients on a local, regional and national level. Our attorneys serve as National Coordinating Counsel for Fortune 500 companies in industry-wide, multi-jurisdictional toxic substance litigation, developing clients’ litigation strategies while managing local and regional counsel. We have defended our clients in almost every state and have tried cases in all of the New England states, New York, New Jersey, the District of Columbia, Pennsylvania, Maryland, Louisiana, Missouri, and Mississippi.

We recently won a multimillion-dollar trial verdict on behalf of a reinsurer in a toxic torts-related matter and prevailed on a motion for summary judgment advocating a novel application of a statute of repose. We are equally skilled in negotiating reasonable settlements, both informally and via alternative dispute resolution.

Our attorneys conduct due diligence on behalf of clients seeking to buy target companies engaged in toxic tort/mass tort litigation, assessing risks and advising clients of potential future claims, successor liability, insurance coverage, and similar issues.

Lawrence G. Cetrulo, founding partner of Cetrulo LLP and chair of our Toxic Tort Practice Group, serves as the court-appointed Liaison Counsel for defendants in Massachusetts and Rhode Island asbestos litigations. Mr. Cetrulo, in conjunction with the firm’s other attorneys, has played an instrumental role in the promulgation of the Massachusetts Asbestos Litigation (MAL) Pre-Trial Orders, which have been widely praised for promoting speedy resolution of claims, predictability in results, and lower litigation costs.

Cetrulo LLP’s close working relationship with the MAL Presiding Judge, Special Master, and opposing counsel allows for early, equitable and efficient resolution of issues among co-defendants and with plaintiff’s counsel.

Lawrence G. Cetrulo, Kyle E. Bjornlund, and Michael J. Cahalane are also the authors of the preeminent treatise on toxic tort litigation, the four-volume “Toxic Torts Litigation Guide,” published by Thomson Reuters.
